3. SCOPE
The following terms and conditions govern all use of NekoBox. For purposes of these Terms of Service (“TOS”), NekoBox is a free mobile Application (“ the Application”) that combines a curated tool list and a Q&A section for UX / UI designers and facilitators.As used herein, NekoBox is defined to include the current Application and all updates, patches, fixes, modifications and enhancements thereto, including releases of new versions, whether provided to you via download, automatically without additional consent or action on your part or otherwise, and any and all accompanying documentation, files and materials. NekoBox is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies and procedures that may be published from time to time on this Application by NekoBox (collectively, the “Agreement”).By accessing or using any part of NekoBox, you agree to become bound by the terms and conditions of these TOS. If you do not agree to all the terms and conditions in these TOS, then you may not access or use NekoBox or any other NekoBox services.
4. Your NekoBox ACCOUNT
Each user of the Application is required to create an account. In creating such an account and agreeing to these TOS, the user agrees that each such user account may only be used by the individual person who created the account, and any additional users (even if associated with the original individual who created a user account) must create their own account(s) to access and utilize the Application.Your NekoBox user account will be available to you online; however, NekoBox reserves the right to freeze or deny access to any account that it believes in its sole discretion is not maintained in accordance with these TOS. You are responsible for maintaining the security of your login information to your NekoBox account and agree to not provide this information to any unauthorized users. You agree to immediately notify NekoBox of any unauthorized uses of your account or any other breaches of security. NekoBox will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. To the extent that you cancel your account, all content in conjunction with your account will be deleted by NekoBox.
5. Responsibility of Users/Contributors
Necessary hardware and software to access the Application are under sole liability of the users. NekoBox reserves the right, in its absolute discretion, to suspend or terminate access or navigation to all or part of the Application and/or its content and/or the available services without prior notice and without entitling any user to claim any indemnity or compensation.It is forbidden to modify the software or any element of it or to use a modified version of the software, in order to obtain unauthorized access to the Application.If you make material available on NekoBox (hereinafter referenced to as “Content”), you are entirely responsible for the content of, and any harm resulting from, that Content, regardless of whether the Content in question constitutes text, graphics, pictures, images, data files, photographs, links, designs, an audio or video file, or any other like materials to be used in the Application.By making Content available, you represent and warrant that:the Content does not contain or install any viruses, worms, malware, Trojan horses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of the NekoBox Application, any hardware or telecommunications equipment;the Content is not spam, is not machine- or randomly-generated, and does not contain unethical or unwanted commercial content designed to drive traffic to third party sites or boost the search engine rankings of third party sites, or to further unlawful acts (such as phishing) or mislead recipients as to the source of the material (such as spoofing);the Content is not unlawful, harmful, threatening, abusive, tortious, defamatory, libelous, vulgar, obscene, child-pornographic, lewd, profane, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;the downloading, copying and use of the Content will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark or trade secret rights, of any third party;
6. Restricted Use
You may not use NekoBox if NekoBox determines or believes, in its sole discretion, that you have violated or attempted to violate these conditions or the spirit of these terms, your ability to use and access NekoBox may be temporarily or permanently revoked, with or without notice.
7. Changes
NekoBox reserves the right, at its sole discretion, to modify or replace any part of these TOS. It is your responsibility to check these TOS periodically for changes. Your continued use of or access to NekoBox following the posting of any changes to these TOS constitutes acceptance of those changes. NekoBox may also, in the future, offer new services (including, the release of new tools and resources). Such new features and/or services shall be subject to the terms and conditions of these TOS.
8. Data Collection and Use
You hereby agree that NekoBox, its parent, subsidiaries, affiliates, and their respective successors and assigns, may collect and use certain technical information associated with your use of NekoBox, including, without limitation, any information provided in connection with any support or technical services for NekoBox.

Personal data means all data that can relate to you personally, such as your name, address, e-mail account(s), user behaviour.The party responsible in accordance with Article 4 Clause 7 of the EU General Data Protection Regulation (GDPR) is Neko Concept You can contact us at nekobox@nekoconcept.com.Whenever you create a user account, contact us by e-mail or through a contact form, we save the data provided by you (your e-mail account and your name) to be able to deliver answers to your questions. The data processed by us are deleted or their procession is limited in accordance with Articles 17 and 18 of the GDPR. Unless explicitly stated otherwise in this data privacy statement, the data stored by us is deleted as soon as it is no longer required for its intended purpose and no legal obligations to retain data prevent its deletion. Limitations are imposed on procession of the data which has not been not deleted because it is required for other legally allowed purposes. You have the right to obtain information about your personal data processed by us. You also have the right to adjust or to delete or to limit procession of your data to an extent legally allowed. Moreover, you have the right to object against procession of your data to an extent permitted by law. The same can be said about the right to “data transmissibility”.
9. Modification of NekoBox
NekoBox may at any time and from time to time modify or discontinue, temporarily or permanently, NekoBox, or any portion thereof, with or without notice. As part of NekoBox, you may from time to time receive updates from NekoBox which may be automatically downloaded and installed to your device. These updates may include bug fixes, feature enhancements or improvements, or entirely new versions of NekoBox. You agree that NekoBox may automatically deliver such updates to you as part of the Service and you shall receive and install them as required. You agree that NekoBox shall not be liable to you or any third party for any such update, modification, suspension or discontinuance of NekoBox.
10. Disclaimer of Warranties
To the extent possible, NekoBox strives to ensure the accuracy and timeliness of the information conveyed on the Application and reserves the right to correct the content at any time and without advance notice. Nevertheless, NekoBox cannot guarantee that the information put on the Application is correct, accurate, or complete. Consequently, NekoBox declines all liability for:any interruption of the Applicationthe presence of bugsany mistake or omission related to the information available on the Applicationany damages resulting from a fraudulent third-party intrusion causing modification of the information put on the Application;and, in general, any damages, direct and indirect, whatever their cause, origin, type, or consequences, losses of profits, clientele, information, or any other loss of intangible assets that could arise as a result of someone having accessed the Application, or being unable to access it, or trusting any information originating directly or indirectly from the Application; or network malfunctions, bugs, or viruses.
12. Governing Law and Dispute Resolution
The Terms of Use are governed and interpreted in accordance with the laws of France. The Terms of Use are available in French and English. In the event of litigation, the French version shall prevail.
